NAB is reluctant to take action despite allegations of political divisions, Supreme Court

The Supreme Court has said that the NAB has been reluctant to take action despite financial allegations on one side of the political divide.

A detailed decision has been issued on the bail petitions of PML-N central leader and National Assembly member Khawaja Saad Rafique and his brother Khawaja Salman Rafique. Despite being hesitant to take action.

The 87-page judgment written by Justice Maqbool Baqir of the Supreme Court on the bail of the Khwaja brothers said that Pakistan was achieved after a long struggle for an independent democratic state, the constitution protects the dignity of every person. People are consistently deprived of their rights. Various accountability laws in the country have been used to suppress political opponents and change allegiances.
The decision said that the principles, tolerance and respect for democratic principles have been ignored, corruption, nepotism, incompetence and intolerance have permeated our society. Our society is mired in corruption, nepotism, incompetence, intolerance and other issues.


On the Khawaja Brothers case, the Supreme Court said that the civil case pending in the lower judiciary was included in the NAB’s reference. In this case, the idea of ​​division of power in the country was trampled underfoot. This case is a classic example of violation of fundamental rights, deprivation of liberty, and insult to human dignity. The current case is a violation of NAB law.

The Supreme Court further said that eradication of corruption is a unique task and measures to eradicate corruption should be in accordance with the mandate of the law. It does not seem that the Khwaja Brothers committed a crime for which there is a NAB trial. The NAB could not establish any connection between the Khwaja Brothers and the Paragon Company. NAB’s detention of eunuchs is not in line with NAB law.

The detailed decision said that the evidence on which the NAB chairman decided to take action was not clear. No institution, no matter how powerful, can abolish the rights enshrined in the Constitution. The purpose of the Constitution is not to deprive the citizens of their rights. The Supreme Court has also asked the trial court to decide without being affected by the observations.

On the other hand, Leader of the Opposition in the National Assembly Shahbaz Sharif and Chairman PPP Bilawal Bhutto Zardari welcomed the decision of the Supreme Court and termed it as historic.

Shahbaz Sharif said that the decision of the Supreme Court in the case against the Khwaja brothers was an indictment against the NAB and the so-called accountability process. Both brothers became victims of political revenge in the name of accountability. The courage and perseverance of Saad Rafique and Salman Rafique is commendable.

Chairman PPP Bilawal Bhutto Zardari while quoting the judgment of Justice Baqir said that the Supreme Court has clarified the role of NAB in political manipulation. Such decisions gradually establish the independence and dignity of the judiciary.
